Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the Road Trippin' Buddy mobile application and related services (together, the "app"), provided by KansTex ("we," "us," or "our"). By downloading, accessing, or using the app, you agree to these Terms. If you do not agree, please do not use the app.

2. Your license to use the app

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, for your own personal, non-commercial road-trip and navigation purposes. You may not copy, modify, reverse-engineer, resell, or redistribute the app except as permitted by law.

3. Safe driving & navigation disclaimer

Your safety comes first. The app provides navigation guidance, points of interest, speed-limit information, ratings, weather, and other travel information as a convenience. It is an aid, not a substitute for safe driving and your own judgment. You agree that:

• You will always obey traffic laws, posted road signs, and actual road conditions, which take precedence over anything the app shows.
• You will not interact with the app in a way that distracts you while driving. Set up your route before you drive, and use hands-free, voice, CarPlay, or a passenger where possible.
• Routing, distances, ETAs, speed-limit data, ratings, and weather may be inaccurate, incomplete, or out of date, and should not be relied upon as the sole basis for driving decisions.
• You are solely responsible for the safe operation of your vehicle at all times.

4. Ratings & user content

The app lets you submit content such as stop ratings, comments, and added places ("User Content"). You retain ownership of your User Content. By submitting it, you grant us a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, and share that content within the app and its community features (for example, showing an aggregate rating for a stop to other travelers).

You represent that your User Content is your own, is accurate to the best of your knowledge, and does not violate any law or third-party right. Community ratings reflect the opinions of individual users, not KansTex, and we do not guarantee their accuracy.

5. Acceptable use

You agree not to use the app to:

• Post content that is unlawful, defamatory, harassing, hateful, deceptive, or infringing.
• Submit false, spam, or manipulative ratings, or interfere with the integrity of community data.
• Disrupt, overload, or attempt to gain unauthorized access to the app or its servers.
• Use the app for any unlawful purpose or in violation of these Terms.

We may remove content or suspend access that we reasonably believe violates these Terms.

6. Third-party services & data

The app relies on third-party services and data sources (including mapping, routing, speed-limit, weather, and informational content providers). We do not control and are not responsible for the accuracy, availability, or content of those services. Your use of features powered by them may also be subject to those providers' terms.

7. Intellectual property

The app, including its software, design, text, graphics, the "Road Trippin' Buddy" name, and the Nelpee mascot and related branding, is owned by KansTex and protected by intellectual-property laws. Except for the limited license granted above, no rights are transferred to you. You may not use our names, logos, or mascot without our prior written permission.

8. Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that any information it provides (including routing, distances, speed limits, ratings, or weather) will be accurate or reliable.

9. Limitation of liability

To the fullest extent permitted by law, KansTex and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the app — including any driving decision made in reliance on the app. To the extent liability cannot be excluded, our total liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or USD $50.

10. Indemnification

You agree to indemnify and hold harmless KansTex from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the app, your User Content, or your violation of these Terms or of any law or third-party right.

11. Termination

You may stop using the app at any time and delete it from your device. We may suspend or terminate your access to the app or its server-based features if you violate these Terms or if we discontinue the app. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

12. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. You agree that any dispute arising out of or relating to these Terms or the app will be subject to the exclusive jurisdiction of the state and federal courts located in Texas, except where prohibited by applicable law.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.
